The majority of www.make.do is open to access without having to register details or create a user account.

2. Using this website
You are permitted to use our website for your own purposes and to print and download material from this website provided that you do not modify any content without our consent. We take all reasonable steps to ensure that this website is available 24 hours every day, 365 days per year. However, websites do sometimes encounter downtime due to server and other technical issues. Therefore we will not be liable if this website is unavailable at any time. This website may be temporarily unavailable due to issues such as system failure, maintenance or repair or for reasons beyond our control. Where possible we will try to give our visitors advance warning of maintenance issues but shall not be obliged to do so.

Terms of Sale

1. Introduction
All orders require an expressed agreement to these Terms of Sale before products can be purchased from this website.

2. Interpretation
In these terms of sale, “we” means Makedo PTY LTD (and “us” and “our” will be construed accordingly); and “you” means our customer or potential customer for products (and “your” will be construed accordingly).

3. Order process
The advertising of products on our website constitutes an “invitation to treat”; and your order for products constitutes a contractual offer. No contract will come into force between you and us unless and until we accept your order in accordance with these terms and conditions at the price specified (including delivery and other charges).
In order to enter into a contract to purchase products from us, you will need to take the following steps: (i) you must add the products you wish to purchase to your shopping cart, and then proceed to the checkout; (ii) at check out you will view a summary of your Makedo items in the cart. At this time you are able to update the contents by adding or removing items; (iii) once you have updated your cart you will enter your billing address and your delivery address (iv) you will then be able to select a delivery method of standard or express shipping. (v) you will be required to enter your email and phone contact details. (vi) you will then be transferred to the Paypal website or remain in the checkout to enter your payment details using either Visa or Mastercard credit cards (vii) you will then confirm your order by pressing the ‘Confirm my order’ button (vii) if you have entered all details correctly you will be transferred through to a page to confirm your order is being processed. If your order details are detected as incorrect, you will be prompted to update the relevant fields (viii) Once your order is completed, you will receive an email confirmation from eWay containing your order details. (iv) once we have checked whether we are able to meet your order, we will either send you an order confirmation within 24 hours (at which point your order will become a binding contract) or we will confirm by email that we are unable to meet your order.
We will not file a copy of these terms of sale specifically in relation to your order. We may update the version of these terms of sale on the website from time to time, and we do not guarantee that the version you have agreed to will remain accessible. We therefore recommend that you download, print and retain a copy of these terms of sale for your records.
The only language in which we provide these terms of sale is English.
Before you place your order, you will have the opportunity of identifying whether you have made any input errors by checking your order. You may correct those input errors before placing your order.

4. Stock of the products
Makedo will endeavour to supply all items publicised on our website. Similarly, products will be removed from this website as soon as we become aware that those items are unavailable.

5. Price and payment
We are an Australian business, however we transact in USD. We will verify prices as part of our sale procedures so that a product’s correct price will be stated when you pay for the product.

Shipping prices are indicated during the checkout process and may be subject to promotional discounts and coupon deals.

Payment must be made upon the submission of your order. We may withhold the products and/or cancel the contract between us if the price is not received from you in full in cleared funds.
The prices on the website include GST for orders within Australia.

Payment for all products must be made by credit card using the Stripe secured payment system or PayPal. Please refer to our Privacy Policy (section 8) for the measures we take to ensure credit card security.  The entire website is secured with a SSL certificate. 

Prices for products are liable to change at any time, but changes will not affect contracts which have come into force.

6. Your warranties and legal capacity
By making an on-line purchase you accept these terms and conditions and acknowledge that you:
(a) are over eighteen (18) years of age, and/or
(b) are entering into a legal contract with us.

Should we suffer any loss or damage, as a result of a transaction entered into by a minor, we reserve the right to take legal action and seek compensation for such losses from the parents or guardians of the minor who caused the order to be placed.

You warrant to us that:
a) you are legally capable of entering into binding contracts, and you have full authority, power and capacity to agree to these terms of sale;
b) the information provided in your order is accurate and complete; and
c) you will be able to accept delivery of the products.

7. Delivery Policy
We will arrange for the products to be delivered to the address for delivery indicated in your order.

7.1. What are my shipping options?
We offer the following options for shipping:

Delivery to the United States (www.make.do)
All orders are dispatched from Nevada within 1 business day and are generally shipped using 2-5 day USPS Priority Mail.

Delivery to Canada (www.make.do)
All orders are dispatched within 1 business day and are shipped from Nevada USA using the most suitable destination-based option (road or air freight) with various carriers. Canadian deliveries generally arrive 4-12 business days from dispatch.

Delivery to Australia (au.make.do)
Standard shipping orders are dispatched from Melbourne within 2 business days and generally arrive  between  2-4 days from dispatch.

Delivery to UK (eu.make.do)
Standard  shipping orders are dispatched from Bristol,  UK  within 1 business day and generally  arrive between  2-3 business days from dispatch.

Delivery to EU countries (eu.make.do)
Standard  shipping orders are dispatched from Bristol,  UK  within 1 business day and generally  arrive  between  5-7 business days from dispatch.

Other countries (int.make.do)
Express shipping orders are dispatched from HK within 2 business days and generally arrive within 3-7 days from dispatch. Standard shipping orders are dispatched from HK within 2 business days and generally arrive between 5-15 business days from dispatch.

Quoted delivery times are only for the following regions: Australia, Canada and United States, UK and Europe, Southeast Asia.

7.2. How much is shipping?
Shipping price varies based on the items you order, region you are located in and shipping method.
To find out how much shipping is, add the items to your shopping cart and proceed to checkout and complete your delivery address details. At this point the updated check out page will display shipping price and method options. Please note, customs fees and additional fees may apply for international shipments. Contact your local customs office for more info.

7.3. How does International Standard Shipping work?
International Orders sent by Standard Shipping arrive in about 3 weeks. However delays can occur in transit or at the local customs office, so it’s possible to take up to 5 weeks for an order to be delivered. Unfortunately, tracking information isn’t available for Standard Shipping. Customs fees and additional fees may apply for international shipments. Contact your local customs office for more information.

7.4. Can I track my shipment?
Tracking is available for the following shipping options:
Express Shipping (A tracking number is available upon request).
No tracking information is available for Standard International shipping options.

7.5. When will my order arrive?
You will receive a shipping confirmation email when your order has shipped from our warehouse.

Canada (www.make.do) - Standard Shipping: 4-12 days from dispatch from warehouse
Australia (au.make.do) - Standard Shipping: 2-4 days from dispatch from warehouse
UK (eu.make.do) - Standard Shipping: 2-3 days from dispatch from warehouse
Europe (eu.make.do) - Standard Shipping: 5-7 days from dispatch from warehouse
International (int.make.do) - Standard Shipping: 5-15 days from dispatch from warehouse
International (int.make.do) - Express Shipping: 7 days from dispatch from warehouse*

*Quoted delivery times are only for the following regions: Canada and United States, Europe, Australia and New Zealand, Southeast Asia. Canadian orders may ship from the US warehouse in Nevada, USA.
 
Please note that the time frames above only represent an estimate of the time it may take for your order to arrive from the date it was shipped. Please check the processing time estimated in your email confirmation to determine when your order will ship. Additional time may be required for customs processing of International shipments.

7.6. What can I do if I haven’t received my order yet?
Standard Shipping: Check the expected delivery time frame in your shipping confirmation email.
Some International shipments can be delayed at country borders, customs, or other routing destinations along the way.
If you still don’t have your order after the time frame provided, check with your local postal and customs offices to see if they are holding your order and contact our Customer Support if they’re unable to find it: hello@make.do .

Australian orders please note: Orders can still take up to 3 weeks from dispatch for standard shipping as they are processed from our overseas warehouse.

8. Risk and ownership
The products will be at your risk from the time of delivery. Ownership of the products will only pass to you upon the later of:
a) delivery of the products; and
b) receipt by us of full payment of all sums due in respect of the products.
We will be entitled to recover payment for the products even where ownership has not passed to you.

9. “Cooling off” period
You may cancel a contract to purchase a product or products at any time within 30 days from when you placed your order (subject to the limitations set out below).
You will not have any such right when any of the products have been unsealed or opened by you.
If you cancel a contract on this basis, you must inform us in writing and return the products to us immediately, in the same condition in which you received them. Products returned by you in accordance with this section will be refunded in full (including the cost of sending the products to you). However, you will be responsible for paying the cost of returning the product to us.
If you cancel a contract on this basis and you do not return the products to us, we may recover the products and charge you for the costs we incur in doing so. Similarly, if you return the products at our expense, we may pass that expense on to you.

9.5 Rejected Delivery
In the event that you reject the delivery of an order and the product is returned to our warehouse in saleable condition, you will be refunded in full (excluding our cost of sending the products to you). However, you will be responsible for paying the cost of returning the product to us.

10. Statutory rights/refunds
The Australian Consumer Law ("Law") which forms part of the Competition and Consumer Act 2010 (Cth) implies into consumer contracts certain statutory conditions and warranties which cannot be excluded, restricted or modified. These are in addition to any voluntary warranties offered by the manufacturer or supplier. Where there is a breach of such a warranty relating to goods or services, and the breach is in terms of the Australian Consumer Law, a "major" failure, then the remedy will be limited to a refund or a replacement, at your election. In all other cases, a breach of such warranty will give rise to a refund or replacement at our election.
As supplier, we provide the following express warranties subject to the following terms and conditions:
(a) We will refund or replace the product as the case may be (with us or you deciding and determining the action to be taken according to whether the failure is major or non-major, as stated above) in the circumstances and to the extent required under the Law if the product you receive does not match the sample or description, is substantially unfit for its intended or disclosed purpose or is not of acceptable quality (as defined in the Law), is unsafe, or if the alleged issue with the product is such that a reasonable consumer aware of the issue would not have acquired the product.
(b) Where a refund or replacement is to be provided under the terms of this warranty, we may to the extent permitted under the Law require the return of the product to us before refunding or replacing it. We will pay for, or reimburse you for, any shipping costs to return the original product to us.
(c) Replacement products are subject to the same warranties as the original.
(d) You must retain your proof of purchase for any manufacturer warranty claims.
(e) Refunds will be issued by direct deposit, cheque or credit card refund at our discretion.
In order to obtain these remedies:
A You must notify us within a reasonable time of supply of the goods. In this context a 'reasonable time' is from the time of supply until a time that it would be reasonable to expect the relevant failure to become apparent, considering the nature of goods. In many cases this will be 7 to 14 days, but in some circumstances may be longer. Please contact us via the help centre. Once contacted we will advise you of the best way to return any products. We may not accept products returned without a Return Authorisation Number.
B Except if and to the extent the Law requires otherwise, replacement of products or refund and reimbursement of freight costs will not be made until the original product is received by us and your claim verified.
C We aim to process refunds and replacements within 28 days of receipt by us of the original product.
D We will not refund or replace a product where in our reasonable opinion the product has following sale to you become of unacceptable quality due to fair wear and tear, misuse, failure to use in accordance with manufacturer's instructions, using it in an abnormal way or failure to take reasonable care.

11. Limitations of liability
Nothing in these terms of sale will limit or exclude your or our liability for: (i) death or personal injury caused by negligence; (ii) fraud or fraudulent misrepresentation; or (iii) any matter for which it would be illegal to limit or exclude, or attempt to limit or exclude, liability.
Subject to this, the products we sell are intended for personal use only and we will not be liable for any business losses (including without limitation loss of income or revenue, loss of business, loss of profits or contracts, loss of anticipated savings, loss of data or waste of management or office time).

12. General terms
Images of products on our website are for illustrative purposes; actual products may differ from such images.
We will treat all your personal information that we collect in connection with your order in accordance with the terms of our
Privacy Policy; use of our website will be subject to our website terms of use. 

Contracts under these terms of sale may only be varied by an instrument in writing signed by both you and us. We may revise these terms of sale from time-to-time, but such revisions will not affect the terms of any contracts which we have entered into with you.

If any provision of these terms of sale is held invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect, and such invalid or unenforceable provisions or portion thereof will be deemed omitted.

No waiver of any provision of these terms of sale, whether by conduct or otherwise, in any one or more instances, will be deemed to be, or be construed as, a further or continuing waiver of that provision or any other provision of these terms of sale.

You may not assign, charge, sub-contract or otherwise transfer any of your rights or obligations arising under these terms of sale. Any attempt by you to do so will be null and void. We may assign, charge, sub-contract or otherwise transfer any of our rights or obligations arising under these terms of sale, at any time – providing such action does not serve to reduce the guarantees benefiting you under these terms of sale.

Each contract under these terms of sale is made for the benefit of the parties to it and is not intended to benefit, or be enforceable by, any other person. The right of the parties to terminate, rescind, or agree any amendment; variation, waiver or settlement under such contracts is not subject to the consent of any person who is not a party to the relevant contract.
These terms of sale contain the entire agreement and understanding of the parties in relation to the purchase of products from our website, and supersede all previous agreements and understandings between the parties in relation to the purchase of products from our website; and each party acknowledges that no representations not expressly contained in these terms of sale have been made by or on behalf of the other party in relation to the purchase of products from our website.

These terms of sale will be governed by and construed in accordance with the laws in force in Victoria, Australian, and the courts of Victoria will have exclusive jurisdiction to adjudicate any dispute arising under or in relation to these terms of sale.

Safety Standard Compliance

Makedo is manufactured to strict engineering standards and tested to meet all mandatory child safety standards for 3+ in the following territories: USA, Canada, Europe, Australia and New Zealand.

In order to comply with these standards, the various Makedo components undergo stringent Physical and Mechanical, Flammability and Toxicity testing.

Quality Assurance

Further to the testing undertaken to meet child safety standards, production is closely monitored by a leading third party safety and quality assurance company. Production inspections and random sampling ensure a high and ever improving production standard.
